very cool and i am glad you won.
it is amazing how we get messed around charged half points and points for accidents that are not our fault.Chevy owner since age 14. 40th year.

Steve, keep in mind that the arb decision is not binding between you and Farmers. That is, Farmers could still deny any claim directly from you and your still right back where you were a year ago. Also, you cannot use the arb decision in a Complaint against the Farmers insured.
Granted, some carriers will go along with the Arb decision and apply it to all involved, but not always.
I'm assuming this is Inter-company Arbitration.
Inter-company arb is almost always done through Arbitration's Forums Inc. Their rules are a lot different then the rules we follow in court proceedings (there is no discovery, no depositions, no questioning of witnesses or information, etc.). For example, I inherited a claim in which the other carrier filed arb. We were 100% liable in the accident and the prior adjuster just denied the claim. I even called the adjuster and offered 90% (no response). I failed to respond to the filing and won. I won as the other party failed to supply a police report and as I did not acknowledge that the accident happened (by responding), they did not prove that the accident happened. Stupidest thing ever.
But I _do_ hope Farmers agrees to address your out of pocket loss. From what I remember of the accident, they should have accepted 100% liability.

Why can't this be simple?? Ok, accident. Witnesses. Pictures. What happened? What do both drivers say, document it. What do witnesses say, document it. Insurance companies, if I could avoid them, I would. I need insurance for my nice truck in case it's damaged but, there's that deductible. And insurance in case I do someone else harm due to a wreck and it's my fault.
There's only one thing I have in common with insurance companies....It's not how much you make, it's how you spend it!

So very glad to hear that things are finally kinda getting resolved! I've had the pleasure of dealing with insurance companies on two separate occasions where it was another driver's fault and both times left me with a disdain for them.

Well, my payback is already $620. Plus I can sue the woman who hit me for up to $5k in Texas small claims court and small claims in Texas is just me and a defendant and an elected JP. So I should have no problem getting back at least 10% on the value of the vehicle as it was at that time from her. She theh hands over a ruling from the JP. I've already talked with an attorney about this, that's what he said.

As a former Farmers Ins. customer, I have to say Congrats on the Win. My wife and I were customers of their's for 6 years(Auto and Homeowners). My wife and I have spotless driving records, have never filed a claim, and over the last 18 months that we were with them our ins. rates went up by 30%.
We switch to State Farm and now have more coverage and are now paying about half of what we were paying with Farmers. Farmers can kiss my big white (__)(__).
