Sounds like you are stuck between a rock and a hard place. Nobody wants to remedy the issue for you. You may have to fix it yourself and go to small claims court for restitution. Identifying diesel by touch and smell will not pass muster in court. Was any of the contaminated fuel saved for evidence? If the fuel from the station was contaminated, you would not be the only one having trouble. Try calling around to other repair shops to identify other victims. Maybe working with your local consumer advocate, someone like Bogey, or Clark Howard could get the attention of the gas station. Good luck.
FUEL and ENGINE ISSUES
I have a 05 GMC Sierra totally stock with the 5.3 I think v8 motor. So this is my issue, I have magnetic flakes in my fuel that somehow got past my fuel filter and into my fuel rail and has now clogged my injectors. I have cleaned up the fuel rail and tops of injectors and it runs a lot better. I have 28k miles so its still underwarrenty. The CEL went on after filling up gas at a Sunoco station, and took it to the dealer and they said it was misfire in #2,7. They sampled the gas at the fuel rail and said it was diesel. My receipt says regular and has now been over a month ago that I filled up. The truck runs just it idles a little rough and the CEL is still on. It blinks when I'm trying to merge on the highway or speed up. I'm dealing with the insurance company for the station, but they claim it's not them...they are going to test the gas and the station to verify. Dealer says it's the gas, although they did notice themselves that it had flakes of crap in it. They made a claim it was diesel based on look and smell of it. They just didn't want to work on it. I've had issues with both places to get anything to happen. Does anyone have a clue what I can do to fix this. The injectors my guess are clogged still because after I cleaned them and the fuel rail it runs a lot better. Washing them is 30-40 each for all 8. Then I need to findout if the fuel filter which is built into the fuel pump on this truck failed, but I'm not allowed to drop it if I want the dealer to cover it. I'm kinda screwed either way, but I need some help on this.

Yeah I did save a half gallon of gas from the tank and fuel rail. My only question is why did all the gunk get stuck in the fuel rail and why am I not getting more of it from the tank. Is there anyway those filters actually allow dirty fuel to the motor? I'd think GMC needs cover that issue because they are large. I agree they did a piss poor job of determining the problem with a smell diagnosis and charging me 2hrs of work. Not all filters are created equally. I've seen oil filters with bad bypass valves that let the oil past the media. I seen plenty of clogged fuel filters, but never one that didn't do it's job. A small amount of diesel shouldn't be a problem, but contaminants like metal particles should be filtered out.
